Retainer Agreement with Oliveri & Larsen
Motion to sign retainer agreement with Oliveri & Larsen. Motion brought forth by Ms Fink, seconded by Mr. Payne.
Discussion – Mr Payne and Ms Fink met with the law firm on 16 December 2024 and had great discussions. We met with Mr Oliveri and one of the new lawyers to the firm. Both showed great enthusiasm for working with the community and following the bylaws, contracts and statutes. Both showed considerations and principles that aligned with the current Boards, which include taking a more legal approach to collections by placing liens sooner rather than later, minimizing fees and costs to the homeowner once they get behind to include relaxing the late fees and the interest. They provided guidelines for a new collections process that the Board can adopt. (We didn’t have anything on paper before.) Mr Oliveri offers to provide a class to the board members which is very nice. The retainer agreement is here.

Collections
Motion to hand over the 4 homeowners who were working with the previous attorney to O&L to continue the collections process.
Discussion – These unit owners were sent letters at the beginning of the management transition in June 2024 stating they should set up payments to the new management agent until a new collections process can be established. The Board was willing to have hearings with these 4 to give them additional relief. Not one of them followed the directions and none of them provided any payments during the 6 month transition period. It appears the only hope of collecting the assessments from these 4 owners is through the attorneys.
Edit Note (1/20/25) These 4 unit owners accounts were turned over to the attorneys on January 2, 2025.
